DMCA Policy

SopKit respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to clear notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA). This DMCA Policy explains the process for submitting a claim of copyright infringement and how we handle such claims.

Filing a DMCA Complaint

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our website, you may notify us by providing the following information in writing:

  1. Identification of the copyrighted work that you claim has been infringed.
  2. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature.

Counter-Notification

If you believe that your material has been removed or disabled as a result of mistake or misidentification, you may submit a counter-notification by providing the following information to our copyright agent:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which SopKit may be found, and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
  4. Your physical or electronic signature.

Repeat Infringers

In accordance with the DMCA and other applicable law, SopKit has adopted a policy of terminating, in appropriate circumstances and at SopKit's sole discretion, users who are deemed to be repeat infringers. SopKit may also at its sole discretion limit access to the website and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Modifications

SopKit reserves the right to modify, alter, or add to this policy, and all affected persons will be bound by such changes. Any changes to this policy will be posted on this page.
